Anti-Gay Bill: Supreme Court Unanimously Dismisses Richard Dela Sky and Dr Amanda’s Odoi’s Case

The Supreme Court has unanimously thrown out a case filed by media personality Richard Dela Sky and a Researcher at the University of Ghana, Dr Amanda Odoi challenging the passage of the Human Sexual Rights and Family Values Bill, commonly referred to as the Anti-LGBTQ+ Bill.

The Supreme Court dismissed both petitions on the grounds that the bill had not yet become law. Presiding Judge Lovelace Johnson clarified that until a bill receives presidential assent, it does not constitute an enactment subject to judicial review of its constitutionality.

Richard Sky’s suit contested the constitutionality of the bill, alleging violations of multiple provisions of the 1992 Constitution, including Articles 33(5), 12(1) and (2), 15(1), 17(1) and (2), 18(2), and 21(1)(a)(b)(d) and (e).

Among the eight reliefs sought by Sky was a declaration that the Speaker of Parliament breached Article 108(a)(ii) by allowing the passage of a bill that imposes financial obligations on the Consolidated Fund or other public resources.

Sky also sought to halt the implementation of the bill, describing it as unconstitutional and an overreach of legislative powers.

The apex court, however, found no merit in his claims and dismissed the case in its entirety.
