The Minority in Parliament has slammed Parliament’s recent letter to the Electoral Commission (EC) declaring a vacancy in the Kpandai Constituency.
According to the Minority Chief Whip Frank Annoh-Dompreh, the move is legally unsound and procedurally reckless.
Addressing the House, Annoh-Dompreh argued that the letter, which was signed by the Clerk to Parliament, should never have been dispatched, especially when a motion for stay of execution relating to the Kpandai Parliamentary Election case is still pending before the courts.
“We strongly submit that the letter that was filed with the Electoral Commission was out of place, was unfortunate, and flies in the face of law and procedural justice. That letter must be withdrawn forthwith.”
It will be recalled that on December 4, 2025, Parliament notified the EC of the vacancy following the Tamale High Court order for a re-run of the 2024 election in the constituency.
The letter addressed to EC Chairperson Jean Mensa and signed by Clerk Ebenezer Ahumah Djietror was anchored on Article 112(5), which mandates Parliament to inform the EC when an MP’s seat becomes vacant.
However, the Minority insists the action was premature and undermines ongoing judicial processes. Annoh-Dompreh maintained that Parliament should not be seen implementing a court directive while an application for a stay of execution is yet to be determined.
“We on this side of the House cannot support that decision,” he said, calling for immediate corrective action. He urged the Speaker to ensure consistency and fairness, recalling previous moments when both sides cooperated despite tight parliamentary numbers.
