We’ll be waiting for you to bring Ofori-Atta back – Frank Davies calls OSP’s bluff

Frank Davies, a member of the legal team representing former Finance Minister Ken Ofori-Atta, has asserted that the Office of the Special Prosecutor (OSP) is within its rights to proceed with legal action against his client, notwithstanding the explanations already offered by the defence.

Mr Ofori-Atta, who is under investigation for suspected corruption, had requested to engage with the OSP through a virtual meeting following an official summons due to ill health.

However, this request was declined. Subsequently, the OSP declared the former minister wanted and initiated processes to secure an INTERPOL Red Notice—an international alert that could result in his arrest and extradition.

In a media interview on Monday, 2nd June 2025, Mr Davies expressed concern over the OSP’s handling of the matter, particularly its alleged disregard for formal communications from Ofori-Atta’s legal representatives.

He accused the office of bypassing due process and acting with prejudice.

“I want to believe that he clearly understands what he is doing. Because you are at the Office of the Special Prosecutor, you can come into the public domain and disclose, as he has said, that there is no medical report. How did he conclude that Ken Ofori-Atta was suffering from cancer?” Mr Davies questioned.

“I am not about to involve myself in frugality. If he says he is going to bring Ken into the country because he is fleeing from justice and has since declared him a fugitive of justice, we will all be waiting for him to bring Ken Ofori-Atta into the country.”

At a press briefing in Accra on the same day, Special Prosecutor Kissi Agyebeng confirmed that a formal request had been submitted to INTERPOL for a Red Notice to be issued.

He stated that the decision was necessitated by Mr Ofori-Atta’s repeated failure to honour invitations for questioning, which the OSP considers as obstructive conduct in relation to ongoing investigations.
