The Minority Leader, Dr. Cassiel Ato Forson accused the Attorney-General, Godfred Yeboah Dame of acting in an unconstitutional, potentially criminal and scandalous manner.
According to him, details of a leaked tape between the Attorney-General and the third accused person, Richard Jakpa in the ambulance purchase trial reveals professional misconduct on the part of the AG.
In a supplementary affidavit supporting a motion for an order of mistrial, injunction, and/or stay of proceedings in the ongoing ambulance case, lawyers for the Ajumako-Enyan-Esiam MP alleged that the Attorney-General attempted to coach the third accused, as captured in the tape, to implicate Dr. Ato Forson in the trial.
In the affidavit filed on Friday, May 31, 2024, Dr Ato Forson’s legal team argued that the Attorney-General’s alleged misconduct warranted the declaration of a mistrial. They emphasized the importance of bringing certain pertinent matters to the court’s attention for the fair and just determination of the case.
“It has become necessary to file this affidavit in order to bring to the attention of the Court and in the interest of justice, certain pertinent, material and relevant matters that have a bearing on the fair and just determination of the current application.”
He further indicated that his legal counsel would seek leave of the court to have the audio recording played during the hearing of the application.
The Minority Leader underscored that failure to order a mistrial in such circumstances, where there are allegations of a blatant disregard for the rule of law and ethical standards of prosecution by the Attorney-General, could severely undermine public confidence in the judicial process.
