Medical Negligence: Widower Sues Graceyard Hospital, Doctor for GH₵2m Over Wife’s Death

A grieving husband has filed a lawsuit at the High Court against Dr. Clement Oppong, a medical doctor at the Ashaiman Municipal Hospital, and his private health facility, Graceyard Hospital, for allegedly breaching their duty of care, which he claims led to the untimely death of his wife through medical negligence.

The plaintiff, Clement Frimpong, alleges professional misconduct and negligence by the defendants, resulting in the death of his wife, Naomi Okyere.

In his statement of claim, filed on August 25 by his lawyers, Liz-Martins Law Consult, Mr. Frimpong stated that his wife had attended regular antenatal care at the Ashaiman Municipal Hospital under the supervision of Dr. Oppong.

However, Dr. Oppong (the first defendant) allegedly directed the couple to his private facility, Graceyard Hospital (the second defendant), for what he described as more effective and personalised medical attention.

According to the suit, Naomi Okyere was admitted to Graceyard Hospital on November 7, 2024, and underwent a cesarean section on November 8, 2024.

She reportedly developed complications, including anaemia, and was subjected to repeated blood transfusions over four days without significant improvement.

The plaintiff contends that Dr. Oppong and Graceyard Hospital breached their duty of care, ultimately leading to his wife’s death. A referral from Graceyard Hospital indicated that the deceased had been diagnosed with severe pre-eclampsia, acute kidney injury, and anaemia.

Mr. Frimpong is seeking GH₵1.5 million in general and special damages for wrongful death, loss of support, and emotional trauma, as well as an additional GH₵500,000 for the upkeep of the couple’s infant child and two other young siblings.

He is further requesting an order revoking Dr. Oppong’s medical license for gross negligence and professional misconduct.

Additionally, the plaintiff is asking the court to shut down and revoke the operational license of Graceyard Hospital for failing to meet minimum patient care standards and regulatory ethics.

He is also seeking costs, including legal fees, and any other reliefs the court may deem fit in the interest of justice, public safety, and accountability in the medical profession.
