The presiding judge in the ambulance purchase trial has set Thursday, June 6, 2024, to deliver her ruling on multiple applications brought by Minority Leader, Dr Cassiel Ato Forson and Richard Jakpa seeking to halt the trial.
Justice Afia Serwaa Asare Botwe, presiding as an additional High Court judge of the Economic and Financial Division decided not to hear arguments in open court, instead opting to rule on the applications while only addressing objections raised by Thaddeus Sory regarding the affidavit opposing their application filed on May 30, 2024.
Thaddeus Sory’s objections were based on three grounds. He argued that the affidavit by State Attorney Richard Gyambiby was inadmissible because it did not disclose the source of the information and that Gyambiby lacked personal knowledge of the facts. Sory cited rules under C.I. 47 governing affidavit evidence, claiming the affidavit was irregular and breached these rules.
Attorney-General Godfred Yeboah Dame opposed the objection, stating that the affidavit did disclose its source and that Sory’s reliance on C.I. 47 was misplaced since it applies to civil, not criminal proceedings.
In answer to a request from Dr. Bassit Bamba, who sought directions on playing the audio recording attached to their affidavit, Justice Asare Botwe humorously noted that she could review the audio herself rejecting the need for a typed transcript.
The court adjourned the session, setting the ruling for Thursday, June 6, 2024.
