Here’s why over 98% of lands in Ghana cannot be registered with a title – Appeal Court Justice

Justice Alexander Osei-Tutu of the Court of Appeal has explained why more than 98 per cent of land in Ghana cannot be fully registered, highlighting the complexities of the country’s land administration system.

Speaking on Joy FM’s Super Morning Show, Justice Osei-Tutu said historical, customary, and legal factors make full land registration challenging. He urged prospective buyers to exercise caution, verify land rights thoroughly, and ensure all documentation is properly obtained before completing transactions.

“Prospective buyers must be aware of these challenges and ensure documentation is properly obtained before completing transactions,” he stressed.

The Justice also called for stronger political will and adequate resourcing for the Lands Commission, arguing that with proper support, the Commission could perform its duties more effectively, streamline registration processes, and protect both landowners and investors.

He added that while full registration of most land may not currently be feasible, improvements in governance, capacity, and legal frameworks could enhance transparency and security in the sector.
